NovaVoke Terms of Service

1. Introduction and Scope

1.1 Acceptance of the Terms

When you click the "Agree" button on the registration or login page, you indicate that you have fully read, understood, and accepted all of these Terms, and have entered into a legally binding agreement with us.

1.2 Changes to the Terms

As our business develops and national laws and regulations change, we reserve the right to modify these Terms at any time. The revised Terms will be published within the NovaVoke App. If you continue to use our services, you are deemed to have accepted the revised Terms.

2. Account Registration, Use, and Security

2.1 Account Registration

You must warrant that the information you provide is true, accurate, and complete. In accordance with the Cybersecurity Law and other applicable laws and regulations, you need to complete registration via a mobile phone number or a third-party social account to use all features.

2.2 Account Safekeeping

Your account is for your own use only and must not be lent, transferred, sold, or shared with others. You bear any loss caused by theft of your account or disclosure of your password due to your own reasons. If you discover that your account has been stolen or that a security vulnerability exists, you should notify us immediately.

3. NovaVoke Service Rules

3.1 Rules for Lawful Use of the Software

When using the NovaVoke service, you must comply with the relevant national laws and regulations and with public order and morals. The following activities are prohibited:

• Reverse-engineering, disassembling, or decompiling the software, or otherwise attempting to discover its source code.
• Using cheats, scripts, modifiers, or other third-party tools to interfere with or undermine the normal operation or fairness of the software.
• Using the software and services to engage in any activities that endanger national security, promote terrorism, disseminate obscene or pornographic content, defame others, or otherwise violate laws and regulations.

3.2 Non-Medical Disclaimer

The cognitive-training modules provided by NovaVoke are merely puzzle-style software tools that assist in improving attention and reaction.

We expressly declare: this product is not a medical device and has no function of medically diagnosing, treating, mitigating, or preventing any disease.

Data generated through use of this product — such as radar charts, accuracy, reaction time, and ability ratings — is for reference only and should not be regarded as professional medical advice. If you have cognitive impairment or other health concerns, please seek medical attention and consult a professional physician promptly.

4. Subscription and Value-Added Service Rules

4.1 Membership Subscription and Auto-Renewal

NovaVoke may offer basic free services and premium subscription services. When you purchase our auto-renewing monthly/quarterly/annual membership, you authorize us or third-party payment channels (such as WeChat, Alipay, or the Apple App Store) to automatically deduct payment from your bound account before your subscription expires, in order to continue your membership for the next cycle.

4.2 Cancellation and Refund Policy

You may cancel the auto-renewing subscription at any time in the auto-payment settings of each platform. Because this application provides online digital goods and virtual services, once sold, refunds without cause are not supported (except as otherwise required by laws and regulations or otherwise agreed by this application).

5. User Conduct and User-Generated Content

If you use the "custom theme" or "content upload" features we provide (for example, uploading visual assets or audio through the admin console), you must ensure that:

• The content you upload is lawful and healthy and does not infringe the intellectual property rights, portrait rights, reputation rights, or other lawful rights and interests of any third party.
• If you upload infringing or unlawful content, you bear all resulting legal liability, and we have the right to immediately delete the relevant content, suspend your account, and report to the relevant administrative or judicial authorities.

6. Intellectual Property

The ownership, copyright, trademark rights, and all other intellectual property rights and lawful rights and interests in the NovaVoke application software and all its elements (including but not limited to software code, UI design, and sound effects) belong to NINGXIA XINGZHUIAO TECHNOLOGY CO., LTD.

Without our express written authorization, no one may use the foregoing intellectual property in any form (including but not limited to copying, distributing, renting, exhibiting, adapting, or compiling).

7. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, we shall not be legally liable for the leakage of your personal information, service interruption, or financial loss caused by the following:

• Force majeure: such as typhoons, earthquakes, tsunamis, floods, power outages, war, terrorist attacks, and other natural disasters or social events.
• Network or technical failures: such as backbone-network failures of telecom carriers, hacker attacks, computer virus intrusions, or paralysis of third-party payment interfaces.
• Your own fault: such as failing to properly safeguard your account password, or failing to operate as required by these Terms.

8. Breach and Termination

If you violate any provision of these Terms, we have the right, depending on the severity, to take the following measures against you without bearing any liability:

• Issue a warning;
• Temporarily freeze the account or restrict functionality;
• Permanently ban the account and terminate services to you;
• Cooperate with public-security and judicial authorities to pursue your legal liability.

9. Governing Law and Dispute Resolution

The formation, effectiveness, performance, interpretation, and dispute resolution of these Terms shall be governed by the laws of the People's Republic of China.

In the event of any dispute or controversy between you and us, the parties shall first resolve it through friendly negotiation; if negotiation fails, you agree to submit the dispute or controversy to the people's court with jurisdiction at the domicile of NINGXIA XINGZHUIAO TECHNOLOGY CO., LTD.
